Use of the Platform

Welcome to Gargi Ayurved, operated and managed by Medwell Healpro Ventures Limited (“Gargi Ayurved”).
The website, its tools, mobile applications, and related services (collectively referred to as the “Platform”) are provided to you subject to the following Terms & Conditions (“Terms of Use” or “User Agreement”).

By accessing, browsing, registering, or purchasing products from the Platform, you agree to be bound by these Terms of Use, whether or not you have read them. These Terms apply for an indefinite period and remain in force for as long as you access or use the Platform.

We reserve the right to modify these Terms at any time without prior notice. Your continued use of the Platform after any changes constitutes acceptance of the revised Terms. Users are encouraged to review these Terms periodically.

Eligibility to Use

The Platform is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872.
Individuals below 18 years of age, undischarged insolvents, or persons legally incompetent to contract are not eligible.
We reserve the right to suspend or terminate access to the Platform at our sole discretion.
If you are registering on behalf of a business entity, you confirm that you have the authority to bind such entity to these Terms.

Gargiayurved delivers products only within India. Users accessing the Platform from outside India do so at their own risk and are responsible for compliance with local laws.

Accuracy of Content & Invitation to Offer

We strive to ensure that all product descriptions, pricing, and content on the Platform are accurate. However:

Product images are for representation only; packaging may vary.
Weights, dimensions, and colors are approximate.
Display variations may occur due to device or screen differences.

All products and services displayed on the Platform constitute an invitation to offer.
Your order constitutes an offer, which is accepted only upon dispatch of the product(s). We reserve the right to accept or reject any order, in part or full, at our discretion.

General Terms of Use

Users agree:

To use the Platform only for lawful purposes.
Not to misuse promotions, offers, or pricing errors.
That prices, availability, and promotions may change without notice.
That Gargiayurveda may cancel orders due to stock unavailability, pricing errors, or verification issues.

If payment has been processed for a canceled order, the amount will be refunded to the original payment method.

Delivery

Delivery timelines typically range from 2–7 business days, depending on location.
Orders may be delivered in multiple shipments.
Gargiayurveda is not liable for delays caused by third-party courier services.

Quantity Restrictions

We reserve the right to limit quantities per order, household, or account.
Unauthorized resale of Gargiayurveda products is strictly prohibited and may result in account termination and legal action.

User Account Responsibilities

Users may maintain one account only.
You are responsible for maintaining confidentiality of login credentials.
You agree that any content submitted (reviews, feedback, comments) is non-confidential and does not infringe third-party rights.

Communications

By using the Platform, you consent to receive transactional and promotional communications via:

SMS
Phone calls
WhatsApp
Push notifications

You may opt out of promotional communications at any time.

Intellectual Property Rights

All content on the Platform, including text, graphics, logos, images, and software, is the intellectual property of Gargiayurveda or its licensors and is protected by applicable laws.

Unauthorized reproduction, modification, distribution, or commercial use is strictly prohibited.

Usage Restrictions

Upload unlawful, obscene, abusive, defamatory, or harmful content.
Infringe intellectual property rights.
Spread malware or harmful code.
Attempt unauthorized access or disrupt Platform security.
Impersonate any person or entity.

Platform Security

Any attempt to breach Platform security may result in civil or criminal liability. Gargiayurved reserves the right to investigate and cooperate with law enforcement authorities.

Indemnity

You agree to indemnify and hold harmless Gargiayurved, its directors, employees, and affiliates from any claims arising from:

Violation of these Terms
Infringement of third-party rights
Misuse of the Platform

Limitation of Liability

The Platform is provided “as is” without warranties of any kind.
Gargiayurved shall not be liable for:

Indirect or consequential damages
Loss of data or profits
Service interruptions
Third-party actions or failures

Maximum liability shall not exceed the value of the product purchased.

Termination

This Agreement may be terminated by:

You, by discontinuing use and requesting account closure, or
Gargi Ayurveda, at its sole discretion, without notice

Termination does not affect payment obligations or accrued liabilities.

Governing Law & Dispute Resolution

These Terms are governed by the laws of India.
All disputes shall be subject to:

Arbitration in Delhi, under the Arbitration & Conciliation Act, 1996
Courts in Delhi shall have exclusive jurisdiction
